Obligations for reporting the State aid
The Romanian State aid grantors (bodies of the central or of the local public administration etc.) have the duty to submit to the Romanian Competition Council (RCC) all the data and information required for the national state aid monitoring, including those aimed at the working out of the reports and information papers within the process of accomplishing Romania’s duties as a Member State of the European Union. This duty should be fulfilled under the provisions of Article 26 (1) in theGovernment Emergency Ordinance no. 77/2014 on national procedures in the state aid field. All the data and information should be submitted in the legal forms, as requested by the Romanian Competition Council.
It should be noted, in this context, that, accordingly to the RCC Regulation on State aid monitoring procedures, all State aid grantors should yearly submit to the Romanian Competition Council, by the end of March, all relevant data and information necessary for the annual reporting: those concerning the State aid granted in the year which the report is worked out for (“the reporting year”), as well as those for the last two years previous to the reporting year. Data and information should be presented in the forms stipulated as patterns in the Annexes 1 – 5 of the above mentioned Regulation.
As concerns the State aid granted by the local public authorities, the relevant data and information requested for the drawing up of State aid Inventory should be reported by the State aid grantors to the territorial inspectorates of the Romanian Competition Council, these branches being also entrusted to ensure the needed consultancy for the State aid grantors.
All State aid grantors should work out their reports both on a paper, and a magnetic supporting material, and should submit them to the Romanian Competition Council either by delivery at its premises, receiving a registration number, and a signature confirming the submitting of the documents, or by sending them by mail, with confirmation for receiving.
Consequently, all State aid grantors should yearly submit to the Romanian Competition Council, by 31 March, all data and information on the period for which the reporting has to be worked out.
